Understanding Absconding Laws in the UAE

It has been remarked that the laws against absconding are formulated within the common law systems of the UAE for regulating and balancing the employers’ and employees’ benefits. It is applicable when the worker has left the employment without any notice to the employer or absents himself or herself from work for a long time. Absconding is defined when an employee is not at their place of work for seven days straight without providing a valid reason for their absence. An employer is able to file such a case with the Ministry of Human Resources and Emiratisation (MOHRE). The person may be subjected to legal repercussions like fines, a labor ban, or, depending on the case, deportation upon reporting it.

Employer’s Role in Reporting Absconding Cases

The employer reports a case of absconding to MOHRE officially within a period prescribed by law. The report must be complete with necessary evidence like attendance records and attempts made at communication. Any failure to follow these prescribed reporting procedures will have penalties conferred on the employer. Thus, these measures have been put in place to protect and ascertain any absconding claims were legitimate and not maliciously made against employees.
